TERMS & CONDITIONS

Ancient Dream reserves the right to change portions of these terms and conditions at any time.

 

1. WHAT IS A PACKAGE HOLIDAY

According to Art. 2.1. of Decree 111 dated 17.03.1995 (which actuates the Directive 90/314/EEC) the tourist packages cover travel, holidays and “all-inclusive” circuits and are the result of a predefined combination of at least two of the following elements, sold and offered for sale at a flat-rate price, and which last more than 24 hours, that is to say, at least one night’s accommodation is included:
a) transport
b) accommodation
c) tourist services non included in transport and accommodation that constitute a significant part of the journey

2. TRAVEL CONTRACT

This travel contract is regulated by the present general conditions and by the clauses in written communications sent to the customer by Ancient Dream. Furthermore it is regulated by the Legislative Decree n° 111 of March 1995 for application of the ECC directive n° 90/314 and by the International Convention for the travel contracts (C.C.V.) ratified with the law n° 1084 of 27.12.1997. In no case responsibility of Ancient Dream will exceed the limits stated by the above mentioned laws.

3. RESERVATIONS

Travels reservations, which must be sent to Ancient Dream using the procedure indicated, are limited and are subject to availability. They are considered accepted and the contract consequently concluded after confirmation sent by fax or e-mail by Ancient Dream to the customer. This happens only after Ancient Dream has received the deposit requested or the full cost of the holiday in case of “last minute” bookings.
Possible further indications regarding the travel requested not contained in the contract or in the brochure will be given by Ancient Dream in good time before the journey beginning in compliance with the obligations stated by Legislative Decree 111/95.

4. PAYMENTS

a) Deposit and registration fee
At the time of booking or within the date communicated by Ancient Dream a deposit of 25% of the total amount together with the registration fee shall be paid in order to secure you space in the holiday wished.
The amount will be considered a deposit for confirmation and an advance payment of part of the entire cost.
Registration fee of a total amount of Eur 20,00 per person will be asked to cover reservation costs, as well as the Insurance Cover of a total amount of Eur 10,00 per person.
b) Balance
The balance should be sent by the customer within 30 working days before the journey departure. The customer has he right to decide to pay the total amount in a single instalment instead of two ones. For booking occurring in the 30 days preceding the departure date, the entire amount shall be paid at the time of booking.
c) Delayed payments
In case Ancient Dream does not receive the requested payments by the agreed dates (in case of payment by credit card Pay Pal will verify payment; in case of bank transfers the customer is kindly requested to fax a copy of the credit transfer receipt) the contract will be terminated.
Should the customer make the payment after expiry of the date communicated by Ancient Dream, acceptance of the booking will be subject to verification of availability. The same happens if the customer provides inaccurate credit card data, as a delay in the payment will probably occur. In case the requested accommodation is no longer available Ancient Dream will offer an alternative solution to the customer who may decide to accept it or not. In the latter case Ancient Dream will refund the entire amount received minus the registration fee within 30 days of receiving payment confirmation from Pay Pal or credit transfer receipt by fax.
d) Method of payment
The traveller may choose one of the following forms of payment:
a) Pay Pal.
b) Bank transfer: the traveller makes a bank transfer to the account indicated by Ancient Dream.
c) travel packages purchased through a different travel agent: the requested amount shall be paid by the traveller to the travel agent who will forward it to Ancient Dream.
To pay services you should settle directly once at your hotel (extra meals, telephone calls, drinks, etc.) please check in hotel description which are the credit cards accepted.

5. PRICES

PRICES ARE quoted in EURO, include the value added tax (VAT) at the current rate. Single room supplements and triple room reductions are specified in each single programme proposed. Prices do not include any personal expenses or additional fees such as telephone calls, items for the mini-bar, tips and whatever is not mentioned under the voice “The price includes”.
According to the above mentioned laws Ancient Dream reserves the right to alter prices only in case of changes justified by variations in:
a) transports costs (fuel, foreign correspondent services, air travel costs)
b) rights and taxes such as landing taxes, embarkation and disembarkation taxes in airports and ports
c) exchange rates
If the global rising of the price is more than 10%, the participant can withdraw from the contract without penalties, upon written communication to Ancient Dream within 48 hours. In no case the price can be increased in the 20 days preceding the expected journey departure date.

6. CUSTOMER WITHDRAWAL AND CANCELLATION POLICY

A) Without penalties
According to the above mentioned laws, the traveller may withdraw from the contract, without paying penalties, if following circumstances occur:
a) if the price increase indicated in the prior point 5. exceeds 10%
b) if a significant change occurs to some other essential element of the contract proposed by Ancient Dream after the conclusion of the contract but before departure and are not accepted by the traveller
c) if it is impossible to take part in the journey due to some serious defect attributable to Ancient Dream.

In the above mentioned cases, the traveller will have the right:
a) to take part in another travel package of an equivalent cost or, if not available, higher cost or lower cost; in this latter case the price difference will be refund
b) to the refund of that part of the cost already paid, which will be given back within 7 working days after Ancient Dream have received the refund request.
c) to accept the modification
Customers are required to give written communication of no acceptance within two working days from receipt of modification or increase notification: should that message not reach ItalySlowTravel offices in due time, the proposal will be understood as accepted.
B) Withdrawal with penalties
Should you need to cancel his booked tour before departure and not for any of the reasons mentions above, he will be charged the registration fee together with the following fees, which will be applied after we receive your written cancellation notice:

-cancellations from 59 to 30 working days before departure date: 10% of the total amount
-cancellations from 29 to 15 working days before departure date: 30% of the total amount
-cancellations from 14 to 9 working days before departure date: 50% of the total amount
-cancellations from 8 to 4 working days before departure date: 75% of the total amount
-cancellations after the above term: 100% of the total amount - this penalty is valuable also for receding after the travel has started (unused services will not be refund), in case of not appearance/no show of the client at departure and in case the required documents for expatriation are lacking or invalid.

The above mentioned cancellation conditions will be applied also in case of tour or departure date changing and to additional accommodations reserved prior to and after the tour.
Termination of the holiday in advance
If the holiday is brought to an end before the foreseen date for personal reasons, no refund is due, unless our suppliers are able to give us back part of the amount paid.

7. TRAVEL CANCELLATION BY ANCIENT DREAM

In case of group bookings, Ancient Dream reserves the right to cancel the travel in case minimum number of participants indicated on each programme is not reached, upon information to the traveller at least 20 days prior to the travel departure date. Ancient Dream will propose a similar tour in case there is one. If our proposal is not accepted by the traveller we will refund the whole amount paid to us without any additional liability.
Ancient Dream is liable for damages suffered by the traveller in case of total or partial failure in providing services, as stated in the contract, either if the services were to be provided directly by Ancient Dream or by third parties unless:
A) Ancient Dream can prove that the traveller himself or herself is responsible for such event (any personal initiative undertaken by the traveller during the tour period is included);
B) extraneous events, not considered in the contract, occur;
C) act of God or fortuitous events (not to be reasonably foreseen by Ancient Dream or solved by professional diligence) may happen, such as: strikes, suspensions or delays for adverse weather conditions, war events and military disorders, terrorist actions, riots, natural disasters, road accidents, water and electricity shortage, interruption in communication and other circumstances beyond our control. Possible additional expenses met by the travellers for these reasons will not be refunded. This is also valid for services that for the same reasons will not be provided.
In case it would be necessary because of external forces, Ancient Dream reserves the right to substitute hotels and holiday destinations with equal services. If the client does not accept Ancient Dream will give him back the amounts received, minus the registration fee.
The baggage travels at risk and danger of travellers and Ancient Dream will not answer for stealing, lost or damages (anyway all our travel proposals are covered with medical and baggage insurance). Furthermore the tour operator is no responsible for any damages caused by the customer.

8. COMPENSATIONS LIMITS

In no case responsibility of Ancient Dream will exceed the limits stated by the laws mentioned at art. 2.

9. CHANGES AFTER DEPARTURE

For changes made to already confirmed bookings, Ancient Dream will have to cover processing costs and sometimes has to pay penalties charged by suppliers. For that reason the customer will be in case requested to pay an extra charge.
-Made by Ancient Dream
Should Ancient Dream be forced to make changes to the journey itinerary after departure because unable to provide an essential part of the services indicated in the contract, for whatever reason except any attributable to the traveller, alternative solutions will have to be offered, with no extra charge to the customer. If the alternative services offered are of a lower value than the original ones the difference will be refund to the traveller.
In case of impossibility to offer alternative solutions or of no acceptance of the same by the traveller (for valid and serious reasons) Ancient Dream is due to offer equivalent and free transport, as stated in the contract, to the departure point or to any other agreed place and will refund the eventual difference of service costs.

10. TRAVELLER RESPONSIBILITY

a) Documents
Travellers must ensure that they have a valid and proper document to enter Italy together with any other extra documents required (visas, medical certificates, etc.). The customer that, for his negligence, should forget the document and be rejected by the Authority, will be considered as renouncing to the travel, and will be applied the procedures as at point 6.b. (withdrawal with penalties) on the present regulation.
b) Membership
The traveller must behave in a manner conducive to group activity all times. In order to assure congenial membership, Ancient Dream reserves the right to accept or reject any person as a tour participant, and to expel from the tour any participant behaving in an unacceptable manner.
C) Damages caused by the customer
Clients are bound to comply with normal prudence and care rules and with the specific ones of the destination countries. In the same way they have to follow the indications and the rules given by the organizer and the administrative dispositions stated in the contract. They will answer for all damages the organizer may suffer due to their non-fulfilment of the above mentioned obligations.
d) Other
Clients are obliged to forward to Ancient Dream all documents and information helpful to the tour operator to exercise its subrogation rights towards third parties and are responsible to the tour operator for the damage caused to the subrogation rights.

11. ASSISTANCE OBLIGATIONS

Ancient Dream is obliged to offer the traveller all the measures of assistance imposed by criteria of professional diligence with exclusive reference to personal obligations as stated by the contract and by the above mentioned laws.

12. CESSION

The traveller who cannot take part in the booked tour, can cede his booking to another person satisfying all the conditions required for the tour (the new customer must especially satisfy the requisites regarding passports, visas and medical certificates), upon information to Ancient Dream at least 4 working days before the departure date. Any costs sustained by Ancient Dream for the replacement shall be paid by the new traveller. Both persons are, anyway, equally responsible for the payment of the tour and of the extra expenses.
In case the supplier is not able to accept this modification, Ancient Dream shall not be considered responsible and will immediately communicate the refuse from the supplier to the customer.

13. COMPLAINTS REGARDING BOOKED SERVICES

In case of complaints regarding the received services the traveller should report immediately to the supplier (hotels, guide, carrier, etc.) in resort and also to the tour operator (in written form) during the holiday so that Ancient Dream can try to remove the problem.
If the complaint is not sorted out during the holiday period, a registered letter should be sent to the tour operator within 10 days from returning from your holiday.
Any suggestions from the client will be anyway gladly accepted in order to improve the level of services and accommodations.

14. TRAVELLERS WHO NEEDS SPECIAL ASSISTANCE AND OTHER SPECIAL REQUIREMENTS

The traveller with any other kind of special requirements shall inform in written form Ancient Dream at the time of reservation. Should the supplier be able to satisfy the special need, Ancient Dream will inform the customer, also about possible extra expenses deriving from the requests.

15. YOUNG TOUR PARTICIPANTS

Tour participants who are less than 18 years old must be accompanied by an adult

17. WARRANT FOUND

A warrant found has been established by the Italian Government Authority to safeguard the client in the case of tour operator insolvency or bankruptcy, safeguarding a holiday refund and repatriation of the clients if abroad.

19. INSURANCE COVER

Ancient Dream is covered by policy number RC n 161291 which has been stipulated with Mondial Assistance Italia S.p.A. insurance company for tort liability, in conformity with the legislative decree 111 of March 17th 1995 and with the regional law L.R.

1. TREATMENT OF PERSONAL DATA - PROTECTION


According to the Italian law "Legislative Decree 196/2003", Travel has the responsibility to protect the confidentiality of your personal information transmitted to us. In detail:
* Ancient Dream will protect customers' information from unauthorized access
* When requested by the customer Ancient Dream will remove his name from the mailing list
* Ancient Dream does not sell customers' names and addresses
The information are stored are shared with our suppliers, who need it to provide the services. The only information we share are the ones necessary to ensure your travel arrangements are executed by these third parties (hotels, car-rental companies, airlines, guides, etc.). Our suppliers will not use your personal data for any other purpose, which is not specifically related to the services we will reserve for you. Some of the information we request to the traveller (name, address, etc.) are necessary to complete travel reservation. Other information are no essential but useful to improve the quality of our services and to tailor your travel experience to your needs, preferences and special wishes.
